HOW A PURCHASE CLOSES

From signed agreement to keys in hand

    Send the agreement

    Send us your signed Agreement of Purchase and Sale and your lender's details as soon as you have them.

  2. 2

    Title search

    We search the title and check for liens, executions and other registrations, and raise any issues with the seller's lawyer.

  3. 3

    Mortgage and insurance

    We receive your lender's mortgage instructions. You arrange home insurance and give us the policy details.

  4. 4

    Sign and fund

    You sign the closing documents a few days before closing and provide the balance of funds needed.

  5. 5

    Closing day

    Funds are exchanged, the transfer and mortgage are registered electronically, and your keys are released.

Selling, condos and refinancing

Selling your home

  • We review your Agreement of Purchase and Sale.
  • We obtain the payout statement for your existing mortgage.
  • You sign the transfer and closing documents before closing.
  • On closing we pay out your mortgage and send you the balance of the proceeds.

Buying a condominium

  • We review the condominium status certificate, often a condition of the offer.
  • We check common expenses, the reserve fund and any special assessments or legal actions.
  • We explain parking and locker units and any rules that affect you.

Refinancing

  • We receive your new lender's instructions and search the title.
  • We pay out the existing mortgage and register the new one.
  • You receive any remaining funds after closing.

WHAT TO BRING

For your signing appointment

  • Two pieces of identification, one government-issued photo ID, for each person signing
  • Your Agreement of Purchase and Sale and any amendments
  • Your lender's contact details and mortgage commitment, if you are borrowing
  • Home insurance details, if you are buying
  • The funds for closing, as confirmed in your statement of adjustments

REAL ESTATE QUESTIONS

When should I contact a lawyer when buying a home?

As early as you can, ideally before you sign the Agreement of Purchase and Sale, or as soon as it is signed. That leaves time to review conditions, the closing date and anything unusual in the agreement.

What is land transfer tax?

Ontario land transfer tax is paid by the buyer when the transfer is registered on closing. It is calculated on the purchase price. Brampton does not charge a separate municipal land transfer tax; the City of Toronto does.

Are first-time home buyers eligible for a refund?

Eligible first-time buyers can receive a refund of Ontario land transfer tax, up to a maximum set by the province. Eligibility depends on your circumstances, so tell us at the start if this may be your first home. Preparing the refund claim may add a small charge.

What is title insurance and do I need it?

Title insurance is a one-time policy that protects against certain problems with the title to a property, such as title fraud or some survey and work-order issues. Many lenders require it. We explain the policy and its cost as part of your quote.

What is a condominium status certificate?

A status certificate is a document from the condominium corporation about the unit and the corporation's finances, including common expenses, the reserve fund and any legal actions. Buyers often make their offer conditional on a lawyer reviewing it.

What happens on closing day?

The balance of the purchase price is sent to the seller's lawyer, the transfer and any mortgage are registered electronically, and the keys are released once registration is complete. We confirm with you when it is done.
